2.投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)人(ren)(ren)在(zai)參加本(ben)項目(mu)投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)前(qian)的(de)(de)三年(nian)內不得(de)在(zai)投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)活(huo)動中(zhong)(zhong)(zhong)存(cun)在(zai)《中(zhong)(zhong)(zhong)華人(ren)(ren)民共和(he)(he)國招(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)法(fa)》第(di)五十三條(tiao)（相互(hu)串通(tong)投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)或(huo)(huo)(huo)者(zhe)(zhe)與招(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)人(ren)(ren)串通(tong)投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)，以向招(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)人(ren)(ren)或(huo)(huo)(huo)者(zhe)(zhe)評標(biao)(biao)(biao)(biao)(biao)(biao)(biao)委員(yuan)會(hui)成(cheng)員(yuan)行賄的(de)(de)手(shou)段謀取中(zhong)(zhong)(zhong)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)）、第(di)五十四條(tiao)（以他人(ren)(ren)名義(yi)投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)或(huo)(huo)(huo)者(zhe)(zhe)以其他方式弄虛作(zuo)假，騙取中(zhong)(zhong)(zhong)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)）、第(di)六十條(tiao)（中(zhong)(zhong)(zhong)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)人(ren)(ren)不履行與招(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)人(ren)(ren)訂立的(de)(de)合(he)同）、《中(zhong)(zhong)(zhong)華人(ren)(ren)民共和(he)(he)國招(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)法(fa)實施條(tiao)例(li)》第(di)七十六條(tiao)（將(jiang)中(zhong)(zhong)(zhong)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)項目(mu)轉讓給(gei)他人(ren)(ren)的(de)(de)，將(jiang)中(zhong)(zhong)(zhong)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)項目(mu)肢解后分別轉讓給(gei)他人(ren)(ren)的(de)(de)，違(wei)(wei)反(fan)招(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)法(fa)和(he)(he)本(ben)條(tiao)例(li)規定將(jiang)中(zhong)(zhong)(zhong)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)項目(mu)的(de)(de)部分主體、關鍵性工作(zuo)分包給(gei)他人(ren)(ren)的(de)(de)，或(huo)(huo)(huo)者(zhe)(zhe)分包人(ren)(ren)再次分包）、第(di)七十七條(tiao)（捏造事(shi)實、偽造材(cai)料或(huo)(huo)(huo)者(zhe)(zhe)以非法(fa)手(shou)段取得(de)證(zheng)明材(cai)料進行投(tou)(tou)(tou)(tou)訴）規定的(de)(de)違(wei)(wei)法(fa)行為，而受到各(ge)級管理(li)部門的(de)(de)處罰(fa)。投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)人(ren)(ren)存(cun)在(zai)前(qian)述處罰(fa)的(de)(de)，在(zai)投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)文件中(zhong)(zhong)(zhong)必須(xu)主動按招(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)文件的(de)(de)要求填報“最近3年(nian)投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)人(ren)(ren)牽(qian)涉的(de)(de)其他（失(shi)信(xin)和(he)(he)違(wei)(wei)法(fa)）處罰(fa)說明”，如果(guo)不主動填報而被事(shi)后發現的(de)(de)，將(jiang)取消其投(tou)(tou)(tou)(tou)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)（中(zhong)(zhong)(zhong)標(biao)(biao)(biao)(biao)(biao)(biao)(biao)）資(zi)格，并按有(you)關規定從重處理(li)。

3.投標人(ren)符合《中(zhong)華人(ren)民共和(he)國招(zhao)標投標法》第二(er)十(shi)六條規定。

4.投(tou)標(biao)人（含其不具有獨(du)立法(fa)人資格的分(fen)支機構(gou)）未被列入“信(xin)(xin)(xin)用(yong)中國”網站(zhan)（ www.creditchina.gov.cn）失信(xin)(xin)(xin)被執行人、重(zhong)大稅(shui)收違法失信(xin)(xin)(xin)主體、政(zheng)府采購嚴重(zhong)違法失信(xin)(xin)(xin)行為記錄名單（處(chu)罰期限屆(jie)滿的除(chu)外(wai)）。

5.根據《中華人(ren)(ren)(ren)(ren)民共和國招(zhao)標(biao)(biao)(biao)(biao)投標(biao)(biao)(biao)(biao)法(fa)實施(shi)條(tiao)例》第三十四(si)條(tiao)規定，與招(zhao)標(biao)(biao)(biao)(biao)人(ren)(ren)(ren)(ren)存(cun)在利害關(guan)系(xi)可(ke)能影(ying)響招(zhao)標(biao)(biao)(biao)(biao)公正(zheng)性(xing)的法(fa)人(ren)(ren)(ren)(ren)、其他組織或者(zhe)個人(ren)(ren)(ren)(ren)，不得參加(jia)投標(biao)(biao)(biao)(biao)；投標(biao)(biao)(biao)(biao)人(ren)(ren)(ren)(ren)負責人(ren)(ren)(ren)(ren)為同(tong)一人(ren)(ren)(ren)(ren)或者(zhe)存(cun)在控(kong)股(gu)、管(guan)理關(guan)系(xi)的不同(tong)投標(biao)(biao)(biao)(biao)人(ren)(ren)(ren)(ren)，不得參加(jia)同(tong)一項目投標(biao)(biao)(biao)(biao)。上述情況一經發現，相關(guan)投標(biao)(biao)(biao)(biao)均無(wu)效。
